These General Terms and Conditions of Sale (“Terms”) govern all purchases of the digital web-design template, model kit or website (“Product”) offered by [DM Conseil] (“Seller”, “we”, “us”, “our”). By purchasing, downloading, or using the Product, the customer (“Buyer”, “you”, “your”) agrees to be bound by these Terms.
NATURE OF THE PRODUCT
1.1 The Product is a digital downloadable web-design template or model kit created using Elementor and compatible with WordPress content management solution only.
1.2 The Product is provided in a digital-only format; no physical items are shipped.
1.3 The Buyer is responsible for ensuring compatibility with their hosting environment, WordPress installation, and Elementor version.
LICENSE AND PERMITTED USE
2.1 Upon purchase, the Buyer receives a exclusive, non-transferable digital file to use the Product on one (1) WordPress website, unless otherwise specified in the purchase details.
2.2 The Buyer may not:
- Resell, redistribute, or share the Product or any part thereof;
- Claim authorship or ownership over the Product;
- Use the Product for multiple client projects unless a multi-use or extended license is explicitly purchased.
2.3 The Buyer may:
- Modify, customize, or adapt the Product for their own project;
- Use the Product for a client website if the client has purchased the appropriate license.
3.1 After the purchase is confirmed, the Product will be delivered via email;
3.2 The Buyer is responsible for saving and backing up their files.
NO REFUNDS OR EXCHANGES (DIGITAL DELIVERY)
4.1 All sales of digital products are final.
4.2 Because the Product is downloadable and cannot be “returned”, no refunds, cancellations, chargebacks, or exchanges will be granted once the purchase is completed.
4.3 By completing the purchase, the Buyer acknowledges and agrees to this no-refund policy.
OPTIONAL SERVICES : INSTALLATION OR CONFIGURATION
5.1 The Buyer may choose to add optional services (with a supplementary fee) to their purchase, including but not limited to:
- Installation of WordPress and the template on the Buyer’s hosting,
- Custom design modifications or personalization,
- Website management, webmastering,
- Additional Elementor-based adjustments,
- Ongoing support or maintenance.
5.2 Prices for optional services will be clearly stated at checkout and must be paid in full before any service begins.
5.3 Optional services are subject to separate timelines and requirements, which will be provided upon purchase.
SUPPORT
6.1 The Product includes basic support limited to:
- Confirming file integrity,
- Installation guidance (up to 3 requests maximum)
- General questions regarding template features.
6.2 Support does not include:
- Custom modifications,
- Troubleshooting unrelated plugins, themes, or hosting issues,
- Fixing security issues;
- Fixing website creation configuration issues;
- Fixing problems caused by the Buyer’s environment or modifications.
6.3 Extended or premium support must be purchased separately.
BUYER RESPONSIBILITIES
The Buyer agrees to:
- Ensure compatibility with WordPress, Elementor, and hosting provider specifications;
- Maintain backups of their website, database and files;
- Use the Product in accordance with applicable laws and licensing terms;
- Update the various plugins, softwares and CMS used on the website;
- Update the Elementor theme or model kit if the seller recommends it;
- Take care of the website’s security by installing a proper security plugin and configuring it so as to maximise the protection from piracy or web attack;
- Regularly backup the website’s file and database so that it can be recovered following a damage an incident or an attack;
- Ensure a proper protection of computer / hardware by installing an antivirus solution and taking all necessary precautions to prevent malwares.
- 8.1 All intellectual property rights related to the Product remain the exclusive property of the Seller.
8.2 Purchase grants a license to use the Product but does not transfer ownership.
LIMITATION OF LIABILITY
9.1 The Product is provided “as is”, without warranties of any kind, whether express or implied.
9.2 The Seller is not liable for:
- Damages resulting from improper template or model kit installation or misuse;
- Website design display problems, that can happen following a CMS (Content Management Solution), webhost, database, plugin, browser, software update or when facing technical instabilities;
- Conflicts with third-party plugins, themes, or hosting environments;
- Business interruptions or data loss related to the webhost or the database provider;
- Online viruses, trojans, malwares, cyberattacks of the CMS , the code, plugins, database, website builder or web host….;
- The website’s CMS, code, plugins, database, website builder or webhost piracy or scrapping;
- Plugin, CMS, code, database, Website builder or Webhost interruptions or dysfunctions
- CMS, code, plugin, database, website builder or web host updates that may have an impact on the website’s functioning or webdesign;
- The database, webhosting, website builder, CMS, plugins and the website’s configuration or misuse.
9.3 The total liability of the Seller shall not exceed the amount paid for the Product.
MODIFICATIONS TO TERMS
10.1 The Seller may update these Terms at any time.
10.2 Continued use of the Product after changes constitute acceptance of the updated Terms.
GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the European Union without regard to its conflict-of-law provisions.
